These Terms and Conditions set out the rules for booking and taking part in boat parties organised under the BoatParty brand (“BoatParty”) and presented on boatpartypoland.com.
Client – a natural person, or a person representing a company or another organisation, who books a private party;
Ticket holder – a person who has bought a ticket to an open ticketed party;
Participant – anyone taking part in a party on board.
§ 2. Booking a private party
We organise private parties in 9 cities: Krakow, Warsaw, Wroclaw, Gdansk, Poznan, Katowice, Bydgoszcz, Szczecin and Torun.
A booking starts when you send the booking form or call us. Parties must be booked at least 5 working days before the planned date.
Once the details are agreed – the date, boarding time and place, route, package, number of participants and extras – we send the Client an e-mail with the final quote. The booking becomes binding once both parties have confirmed it.
Until the booking is confirmed, BoatParty may change the price of the service. The price confirmed in the booking is final.
The prices of the Basic, Star and VIP packages shown on the city pages are per person and apply to groups of 30 or more. For smaller groups we prepare an individual quote.
Every package includes 2 hours of boat hire. The departure time is agreed individually.
The packages and extras are described on the offer pages. The scope confirmed in the quote is binding.
We issue VAT invoices to companies.
§ 3. Payment, cancellation and changes of date
The amount and deadline of the deposit, and the deadline and method of paying the balance, are given in the booking confirmation.
If the Client cancels the party later than 5 working days before its date, the Client covers the full cost of the party, and the deposit and any other payments are non-refundable.
If the party does not take place through the fault of BoatParty, we refund all amounts paid towards it.
If the cruise cannot take place for reasons beyond BoatParty’s control, in particular weather conditions, the water level, or a decision of the captain or the competent authorities, we will offer another date. If no new date is agreed, we refund the amounts paid.
If the party is interrupted or does not take place because participants breach these Terms and Conditions or the safety rules, the Client is not entitled to a refund of the amounts paid.
Changes of date are agreed individually, depending on the availability of the boat.
§ 4. Ticketed parties
We run open ticketed parties in Krakow, Warsaw and Wroclaw. The dates, programme, meeting point and ticket price are given on the page of each party.
After sending the form, the Ticket holder receives an e-mail booking confirmation with the ticket attached as a PDF. There is no need to print the ticket – just show it on your phone or give our organisers the name of the person who made the booking.
By buying a ticket, the Ticket holder accepts these Terms and Conditions.
The price paid for a ticket is final and does not change once payment has been made.
Tickets are non-refundable unless the party did not take place through the fault of BoatParty or due to force majeure – in that case we refund 100% of the ticket price.
A Ticket holder removed from the party for breaching these Terms and Conditions or the safety rules is not entitled to a refund of the ticket price.
Ticketed parties are open to adults (18+) only.
§ 5. Vouchers
A cruise voucher is valid for 6 months from the date of purchase.
The date of a voucher cruise is agreed with the voucher holder, depending on the availability of the boats.
§ 6. Safety rules
Participants must follow the instructions of the captain, the crew and BoatParty representatives given for safety and for the smooth running of the party.
On board it is forbidden to:
behave in any way that may cause injury or put anyone’s life at risk;
obstruct the captain or the crew or distract them;
lean over the side, sit on or climb the railings, or jump into the water;
enter the wheelhouse, the engine room or any other area closed to guests;
throw rubbish or any objects overboard – rubbish goes into the bags or bins provided;
bring dangerous items on board;
smoke cigarettes or e-cigarettes outside the area indicated by the crew;
damage the boat or its equipment.
Participants may bring their own alcohol if their package includes it: it is included in the Star package and available as an extra with the other packages. Alcohol may only be consumed by adults.
A person who breaks the safety rules, puts others at risk or is heavily under the influence of alcohol or drugs may be refused boarding or removed from the party.
§ 7. Liability
BoatParty is liable for the proper performance of the service and for the actions of its staff and contractors during the party, in accordance with the law.
BoatParty is not liable for damage resulting from participants breaching these Terms and Conditions or the crew’s instructions, in particular under the influence of alcohol or drugs.
The Client and the participants are liable under the Polish Civil Code for damage caused to property belonging to BoatParty or to the owner of the boat.
BoatParty is not liable for items left unattended on board.
§ 8. Complaints
Complaints about a party can be made through the contact form on boatpartypoland.com.
Please describe what the complaint concerns and give the date of the party and your contact details.
We reply to complaints within 14 days of receiving them.
Consumers may use out-of-court complaint and redress procedures, for example the help of a municipal or district consumer ombudsman (rzecznik konsumentów).
§ 9. Final provisions
Consumers have no right to withdraw from a distance contract, as it concerns a leisure service provided on a specified date (Article 38(1)(12) of the Polish Consumer Rights Act of 30 May 2014). The cancellation rules are set out in § 3.
